1. Definitions

In these terms the following meanings shall apply:

‘We’ and ‘Us’ means ‘Rance Landscapes Ltd’ or ‘Rance Turf and Soil Supplies’
‘You’ means the person seeking to purchase goods from us or secure our services

2. The Contract

2.1
We accept all orders for supply of goods and our services only under these terms.

3. Quotations

3.1
Prices quoted to you are based on the costs prevailing at the time they are given and will be valid for no more than 90 days from the date of the quotation. Costs given are applicable to the quantity of goods required, the number of days labour required to complete the works, and on the information provided by you at the time of the quotation. In the event that you change any of the specifications in any way, or if there is any variation to the works, we shall adjust the prices quoted to take account of the changes, which will be agreed with you at the time.



4. Payment

4.1
We will accept payments by Credit Card subject to the following surcharges:

Mastercard: 2%
Visa Credit: 2%
Commercial/Business Cards 2.6%

We will accept payments by Visa Delta, Switch or other debit card facility without surcharge.

4.2
We reserve the right to claim interest on all late payments at the rate of 8% per annum above the Bank of England base rate in force from the time from the due date until the date of payment, after as well as before judgement. This is in accordance with the late payment of commercial debts (interest) act 1998.

4.3
We shall be entitled at any time to recover any or all of the goods in your possession to which we have title and for that purpose we our employees or agents may with such transport as is necessary enter upon any premises occupied by you or to which you have access and where the goods may be or believed to be situated.

4.4
You may not withhold payment of any invoice or other amount due to us by reason of any right of set off or counterclaim which you may have or allege to have for any reason whatever.

5. Delivery

5.1
Deliveries are made to the kerb side or to where the vehicle can reasonably gain access. If our delivery vehicle is kept waiting for an unreasonable time or is obliged to return without completing the delivery, we reserve the right to make an additional charge.

5.2
Delivery will be effected when the goods leave our premises whether carried by us or an independent carrier or the premises of our suppliers when the goods are delivered direct from suppliers.

5.3
Delivery times are given in good faith but are estimates only and can not be guaranteed, as they are affected by traffic conditions etc which are outside the control of the company.

5.4
For the avoidance of doubt and without detracting from any other provisions of these terms, we shall not be liable for any damages whatsoever whether direct or indirect (including any liability to any third party) resulting from any delay in delivery of the goods or failure to deliver the goods in a reasonable time whether such delay or failure is caused by our negligence or otherwise howsoever.

5.5
If the goods are to be deposited other than on your private premises, you shall be responsible for the compliance with all regulations and for all steps which need to be taken for the protection at all times of persons and property.

5.6
You will indemnify us in respect of all costs, claims, losses or expenses we may incur as a result of delivery in accordance with your instructions. This indemnity will be reduced in proportion to the extent that such costs, claims, losses or expenses are due to our negligence.

5.7
Turf must be inspected on receipt and laid within 12 hours (April-Sept) or within 24 hrs (Oct-March).

5.8
Any orders for turf must be cancelled at least 48hrs before the due date of delivery, otherwise the full amount for the order will become payable.
Any orders for soil must be cancelled at least 24hrs before the due date of delivery, otherwise we shall charge a haulage fee proportionate to the delivery.

6. Inspection

6.1
You shall inspect the goods at the place and time of unloading.

6.2
You must advise us immediately by informing the driver or by contacting us by telephone, on Tel: 01923 333385 or 07956402551, If you are not fully satisfied with your goods for any reason after inspection, you must inform us before we leave the site of delivery.

6.3
If you fail to advise us immediately, the goods will be deemed to have been accepted by you, and you shall be liable for payment for the goods in full.
